Help If you know someone who has court
charges for drug and/or alcohol related crimes, intervention and
alternative sentencing may be possible. This is always at the
discretion of the Court, but prosecutors and judges may be
willing to remand a defendant to a faith-based program (i.e.
Teen Challenge) rather than sentencing them to a jail. The
following law review publication may be used to show victims,
prosecutors and judges how the defendant can get the help he or
she desperately needs, and it benefits society too because the
State does not need to pay for the incarceration.
Purpose of the Article: This article was an attempt to
allow courts to:
1. Not only feel comfortable with the alternative sentencing
(i.e. sending a defendant to a faith-based program so they can
get help with their drug/alcohol problem, thus minimize the
probability of future crime), but also
2. Have a constitutional framework around which they can operate
legally to accomplish these common goals.
